The new law has put the whole world of online trading into an uproar. But what is hidden behind this law? Since 1st of April, 2016, the law to the alternative dispute resolution has been in force.

Benefits of the alternative dispute resolution

The law on alternative dispute resolution for consumer disputes aims to relieve courts whilst, on the other hand, gives consumers a simple way to settle disputes.

To give an example, consumers who buy online and do not receive their ordered items can contact the online dispute resolution (ODR-platform) and do not have to take the long and expensive way to court.

The way to court is often cost-intensive and complicated from the perspective of the consumer and it is - compared to the value in dispute - usually not worth the effort. In such cases the alternative dispute resolution is worth a try.

Settlements of the alternative dispute resolution entity are not legally binding. If enterprises or online retailers are declining the decision of the alternative dispute resolution entity, the regular legal process is still open to both parties. The settlement of the alternative dispute resolution entity may then help to evaluate the situation with which risks of a legal process can be assessed.

The law on alternative dispute resolution for consumer disputes therefore aids to make online trading safer and to provide greater security for consumers in e-commerce.

What does the law on alternative dispute resolution for consumer disputes mean for me as an online retailer?

Through the law on alternative dispute resolution for consumer disputes arise specific information obligations for online retailers. According to the ODR regulation, online traders have to refer to the opportunity of the alternative dispute resolution and add a link to the ODR-platform in their terms and conditions and legal notice since the 9th of January, 2016.

Additionally, from the 1st of February, 2017, other information obligations are required through the consumer dispute resolution law.

Online retailers with more than 10 employees have to inform to what extent they are open or obligated to attend the alternative dispute resolution procedure in their terms and conditions.

Who wants or is obligated to attend dispute resolution procedure has to add information like their address and website of the consumer dispute resolution entity.
