By 01/01/2018 at the latest the T&Cs/customer information must be changed. The reason for this is, on the one hand, the "Act on the Reform of Construction Contract Law" and the "Amendment of Liability for Defects under Sales Law", which come into force on 1 January 2018. The resulting changes to the German Civil Code (BGB) affect, among other things, the seller's liability for defects under sales law and have effects on the legal texts.
On the other hand, current case law on the agreement of liability exclusions has further restricted corresponding general terms and conditions clauses, so that it is no longer possible to provide for a regulation that is both substantive and also safe from warnings. As a result, it is necessary to adjust the T&Cs/customer information.
